1.            Introduction

Laguna Displays Inc. (“LAGUNA DISPLAYS”) values your privacy and works hard to protect it.  We are committed to providing you with transparent notice of how your Personal Information is collected, processed, disclosed, and retained by us and our employees, contractors, and service providers.  This Privacy Notice describes our policies and practices regarding the collection and use of your Personal Information and sets forth your privacy rights.  Because information privacy is an ongoing responsibility, we will update this Privacy Notice periodically as we implement or adopt new privacy policies.

2.            Application

This Privacy Notice applies to LAGUNA DISPLAYS’ websites, products, and services which link to or reference this Privacy Notice.  Additional information about how we process Personal Information may be obtained in other documents specific to the products or services we offer. Please note that LAGUNA DISPLAYS processes Personal Information for its Customers as part of its service offerings. In such cases, a separate privacy notice (“Product Notice”) may apply. If any Product Notice conflicts with this Privacy Notice, the specific Product Notice will take precedence. 

LAGUNA DISPLAYS has its headquarters in the United States and the Personal Information collected will be processed in the United States. LAGUNA DISPLAYS is also established in the European Union and our website, products, and services may currently be accessed or used by data subjects located in the European Union.

3.            What This Privacy Notices Covers

This Privacy Notice addresses the following Personal Information collection and processing practices of LAGUNA DISPLAYS.  This Privacy Notice does not address the data collection or processing activities of our Clients, Suppliers, or Partners, whose practices are separate and unique from ours.

4.            Personal Information We Collect

LAGUNA DISPLAYS collects Personal Information when you use our websites, products, and services. “Personal Information” denotes information which identifies, relates to, describes, is capable of being associated with, or could reasonably be linked to a particular person. Such Personal Information may include your name, email address, address, phone number, and other information.  If we link other data with your Personal Information, we treat that linked data as Personal Information.

The Personal Information we collect falls within two categories: 1) Personal Information you give to us; 2) Information we collect automatically. Some of the Personal Information we request from you is required in order for you to use our websites, products and services.  If you do not wish to provide such Personal Information to us, you are not obligated to, but you may not be able to use particular features of our websites, products, or services.

(a) The Personal Information You Give Us.

Contact Information: You may provide Personal Information to us when you fill-out a form to have a representative contact you about our products and services. This may include your first and last name, email address, phone number, physical address, and any other information you choose to include in the forms (“Contact Information”).

Communications. If you correspond with us by email, the postal service, or other form of communication, we may retain such correspondence and the information contained in it, and use it to respond to your inquiry and notify you of events, publications, or other services. If you request we not contact you by email at a certain email address, we will retain a copy of that email address on its “master do not send” list in order to comply with your no-contact request.  We may still send you non-marketing emails related to your relationship with us.  If you provide us with a phone number, you agree that we may contact you via telephone, text, or messaging service.

Filling Out a Form Online: When you fill-out a form or submit information to us via our website, we collect any personal information your provide to us and use it for the purposes of fulfilling the request or purpose of submitting the information. 

(b) Information We Collect Automatically

Like most websites, ours collect certain information automatically and stores it in log files. We use this information to help us design our website to better suit our users’ needs. We do not respond to Do Not Track (DNT) signals.

Usage Information: We collect the IP addresses of all visitors to our websites and clickstream and other related information, such as information about your computer or device, web browser and operating system and their settings, the referring page that linked you to our websites, the pages, content or ads you see or click on during your visit and when and for how long you do so, items you download, the next website you visit when you leave our websites, any search terms you have entered on our websites, and whether you interact with email messages, for example, if you opened, clicked on, or forwarded the email message.

Log Data: We automatically collect log information when you use the services, even if you have not registered for an account or logged in. That information includes, among other things, details about how you have used our website (including links to third party sites or services), Internet Protocol (IP) address, access times, your browser type and operating system, device information, device event information (e.g., crashes, browser type), and the page you’ve viewed or engaged with before or after using the Platform.

Cookies: To enhance your experience on our Website, we place "cookies" on your computer or device. Cookies are small text files that we place in your computer or device to store your preferences. Other information you provide to us may be linked to the data stored in the cookie. A cookie assigns a unique numerical identifier to your Web browser or device, and may enable us to recognize you as the same user who has used our website, and relate your use of the website to other information about you. We use these to provide enhanced functionality of the website and aggregate traffic data. Google Analytics cookie to collect anonymous traffic data. They contain a random unique visitor ID, timestamps and information about the visit, including referrals.

It contains a unique identifier called customer guide to recognize returning visitors.

 

HTML 5: HTML5, the language some websites are coded in, may be used to store information on your computer or device about your website usage activities. This information may be retrieved by us to help us manage our websites, such as by giving us information about how our websites are being used by our visitors, how they can be improved, and to customize them for our users.

Cache Cookies: Cache cookies, such as eTags, may be used to identify your computer or device as the same computer or device that visited a website or websites in the past.

Location-Based Information: With your consent, we or our authorized service providers and partners may use precise geolocation technology such as GPS or Wi-Fi triangulation or mobile Bluetooth beacon technology to collect information about the exact location of your mobile device. Precise location information may be collected both while you are using one of our mobile applications and continuously over time while our apps are not in use but are running in the background of your device. You can withdraw your consent to the further collection and use of your precise device location data through any of our mobile apps by accessing your device’s privacy settings. 

(c) Information We Receive From Third Parties

We may receive information about you from our service providers and business partners, including companies that assist with processing, analytics, data processing and management (e.g. to measure ad quality and responses to ads, and to display ads that are more likely to be relevant to you) account management, hosting, customer and technical support, and other services which we use to personalize your experience.

5.            Your Choices Regarding Personal Information

You have choices regarding how we use your Personal Information. We respect your choices and attempt to honor them whenever possible.  We allow you to opt-out of email marketing at your discretion.  Additionally, you can alter your device and browser setting to refuse the placement of third-party cookies and location based tracking.

You may opt-out of any commercial emails sent by us by unsubscribing from them in the link provided in the email.

Cookies.

You can use your web browser to directly block all cookies, or just third-party cookies, through your browser settings. 6.            How We Process Your Personal Information

We use your Personal Information for the purposes outlined below as well as those purposes outlined in the applicable Product Notices. We process Personal Information for our operational purposes, including the following:

  • Performance of our contractual services. This includes processing Personal Information necessary to provide you with the services you have requested.
  • Auditing or analytics related to current and concurrent transactions with you, including counting ad impressions to unique visitors, verifying the positioning and quality of ad impressions, and auditing compliance.

7.            Disclosure of Your Information

We may share your Personal Information with third parties from time to time. We may also share your Personal Information with others when you have agreed for us to do so.

Third Party Service Providers. We may share your Personal Information with third party service providers who perform various functions to enable us to provide our services and help us operate our business. We contractually require service providers to keep data secure and confidential, and we don’t allow service providers to disclose Personal Information without our authorization or to use it for their own purposes. These service providers may include data storage providers, payment card processors, analytics providers, and other providers of business services.

Protection of LAGUNA DISPLAYS and Others. We may share Personal Information when we believe it is appropriate to enforce or apply our contractual agreements or protect the rights, property, or safety of LAGUNA DISPLAYS, our products and services, our users, or others.  This includes exchanging information with other companies and organizations for fraud protection and risk reduction. 

Advertising. We may use the Personal Information we have collected from you to enable us to display advertisements to our advertisers' target audiences. Even though we do not disclose your Personal Information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.

Response to Subpoenas and Other Legal Requests.  We may share your Personal Information with courts, law enforcement agencies, or other government bodies when we have a good faith belief we're required or permitted to do so by law, including to meet national security or law enforcement requirements, to protect our company, or to respond to a court order, subpoena, search warrant, or other law enforcement request.

Sale of Our Business.  If we sell, merge, or transfer any part of our business, we may be required to share your Personal Information.

With your Consent. Other than as set out above, we will provide you with notice and the opportunity to choose when your Personal Information may be shared with other third parties.

Third Party Links. The Website may include links to third-party websites, plug-ins and applications. Clicking on those links or enabling those connections may allow third parties to collect or share data about you. When you visit a page that includes one of these sharing tools, the third party company that operates the tool may be collecting information about your browser, device, and online activity through its own tracking technologies and subject to its own separate privacy policy. We do not control these third-party websites and are not responsible for their privacy statements. When you leave our website, we encourage you to read the privacy notice of every website you visit.

8.            Protection of Your Personal Information

We have put in place appropriate security measures to prevent your Personal Information from being accidentally lost, used or accessed in an unauthorized way, altered or disclosed. In addition, we limit access to your Personal Information to those employees, agents, contractors and other third parties who have a business need to know.  We have put in place procedures to address any suspected Personal Information breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

9.            Managing Your Personal Information

In most cases, you can review and change your Personal Information by logging into your account on the website and visiting your account profile page. You may also send us an email at info@lagunadisplays.com request access to, correct or delete any Personal Information that you have provided to us. We cannot delete certain Personal Information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

10.         Other Rights

Your California Privacy Rights: Notice to California Consumers

If you are a California resident, you also have the ability to ask us for a notice identifying the categories of Personal Information, as defined by California Civil Code Section 1798.83, we share with our affiliates and/or third parties for their direct marketing purposes and the contact information for such affiliates and/or third parties (under California Civil Code Sections 1798.83-1798.84). A Note for Parents or Guardians

Our website, products, and services are not intended for children under 13 years of age. No one under age 13 may provide any information to the Website. We do not knowingly collect personal information from children under 13. If you are under 13, do not use or provide any information on this Website or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information.
